CONSENT TO USAGE AND PROCESSING OF PERSONAL DATA

Pursuant to Section 13 of Italian Legislative Decree no. 196 dated 30 June 2003 (Italian Personal Data Protection Code), please be informed that Automobili Lamborghini S.p.A. (“Lamborghini”) in its quality of Data Controller and the dealer Saudi Arabian Marketing & Agencies Company Limited (SAMACO) (“Dealer”) in its quality of data controller too will process your personal data in compliance with applicable laws.

Accordingly, please note the following terms:

Purposes of Processing
The personal data you provide will be processed for the following purposes:
a) for contractual purposes as to execute sales or services agreements or the vehicle manufacturer ’s warranty obligations;
b) subject to your express consent, to provide you with sales and/or promotional information about Lamborghini products and for market research and surveys.

Methods of Processing and Location of Storage
Your personal data will be processed for the purposes specified above using both automated and non-automated tools, in accordance with the principles of confidentiality and security measures prescribed by law (both applicable Saudi Law and Italian Personal Data Protection Code). The data shall be stored in Lamborghini’s systems located in Germany and in Italy and in the Dealer’s system.

Entities who may gain access to Personal Data
The personal data shall be disclosed by the Data Controllers to the appointed Data Processors and People in charge of processing. The personal data shall not be released.

Consequences of Providing Personal Data
The decision to provide your personal data for the purpose specified in letter a) of the above Section “Purposes of processing” is mandatory, since your failure to provide your personal data may make it impossible to execute the agreement.
The decision to give your consent to the processing of your personal data for the purpose specified in letter b) of the above Section “Purposes of processing” is discretionary, since it is not arising from a law duty and it is subject to your express consent. In this case, your failure to provide your consent will prevent you from being provided with sales and/or promotional information and the involving in market research.

Data Subject Rights
Pursuant to Section 7 of Italian Legislative Decree no. 196 dated 30 June 2003 (set out in Appendix 1 hereto), you have some rights that Lamborghini and/or the Dealer is obligated to honor. The following are the most important rights you may exercise:
 to obtain confirmation of whether or not Lamborghini and/or the Dealer is in possession of your personal data;
 to be informed of the source of your personal data, and of the purposes and methods of its processing;
 to obtain the deletion, blockage of use, updating, correction or supplementation of your personal data;
 to prohibit the processing of your personal data for commercial, advertising or market research purposes;
 to identify the Data Processors and the Data Controllers.

It is understood that the rights set forth in Section 7 of the Italian Personal Data Code (set out in Appendix 1 hereto) could be exercised by the Data Subject without formality by sending a request:

By executing this CONSENT TO USAGE AND PROCESSING OF PERSONAL DATA form, you hereby acknowledge and agree that (i) you are providing your personal data to be processed by Lamborghini and/or the Dealer for the purposes specified in letter a) of the above Section “Purposes of processing”, and (ii) the Dealer may disclose your personal data if required to do so by applicable law or at the request of any governmental authority, or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect and defend the rights or property of the Dealer or its affiliates, or (c) protect against legal liability.

to allow the processing of my personal data with the purpose of receiving advertising and/or promotional material (information on future services, offers, brochures, invitations to events) and to be contacted for market research, directly by Lamborghini and/or the Dealer and/or by other entities operating on behalf of Lamborghini and/or the Dealer in the terms set forth in letter b) of the above Section “Purposes of processing”.
Governing Law & Jurisdiction
This form shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.

Any dispute arising out of or in connection with this form, the subject-matter hereof, or its interpretation that cannot be resolved amicably shall be referred to and resolved by the Saudi courts in Jeddah, Saudi Arabia.

Appendix 1
Italian Personal Data Code
Section 7 (Right to Access Personal Data and Other Rights)

  1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.

  2. A data subject shall have the right to be informed
    a) of the source of the personal data
    b) of the purposes and methods of the processing
    c) of the logic applied to the processing, if the latter is carried out with the help of electronic means
    d) of the identification data concerning data controller, data processors and the representative designated as per Section 5(2)
    e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.

  3. A data subject shall have the right to obtain
    a) updating, rectification or, where interested therein, integration of the data
    b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed
    c) certification to the effect that the operation
    d) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.

  4. A data subject shall have the right to object, in whole or in part, a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection; b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
